What is the difference between an unsecured and secured note?
An unsecured note is just a promise to pay. A secured note ties the loan to a piece of real estate (using a Mortgage or Deed of Trust). If the borrower doesn't pay a secured note, the lender has the legal right to foreclose on the property to get their money back.
Do I need to record this document at the courthouse?
The Promissory Note is kept for your private records. However, if you purchase the Premium Package, the "Deed of Trust" or "Mortgage" document must be recorded with the local county clerk to officially place the lien on the property.
