Do you provide Intellectual services for trademark in México?
Sure, I am a licensed Attorney qualified to represent individuals and companies before the IP Office in México.
Is there a time frame for the trademark registration approval?
In Mexico, the maximum term established by law for the approval of the registry is 6 months, if no objections or oppositions arise. However, I am managing to speed up the times to an average of 3 months with the clean entry of the Application.
What kind of information do you need to register the trademark?
The mandatory data is: 1. the applicant’s complete name, address, nationality; 2. Trademark Name (if any) and/or a digital sample of the logo (if any); and 3. the Products or Services that you want to protect (I will be in charge of carrying out the Classification)
Once my trademark has been registered, for how many years will be valid?
The trademark will be valid for 10 years starting from the date of registration approval and they can renew as many times as needed. You will need to file a trademark renewal and pay a renewal fee six months before or six months after the expiration.
Do I need a Power of Attorney?
No, you do not need to provide power of attorney to register your trademark. In some cases it may be recommended or necessary, if it is your case I will let you know.
Are the IP Office Fees included in the price?
Yes, IP Office Fees are included. If you want to protect more than two Classes for the same Mark, let me know and I will try to find a preferential Fee for my Attorney Fees.
How much is the IP Office Fee?
175 USD: The IP Office Fee is around 165 USD per Class, keep in mind that the Fiverr fee is 20% and that a currency exchange must be made from USD to MXN and this payment corresponds entirely to the Applicant. Therefore, a TOTAL OF 198 USD. (They are included in the Basic and Standard Packs)
Having a registered trademark in other country protects me in Mexico?
Having a trademark in another country does not create any rights in Mexico. To have a right in Mexico, you have to file a Mexican trademark application.
Can I order any of the Packs without talking to you first?
For the Basic and Standard package yes you can do it. For the Premium Package you will need to contact me to determine the total fees for the IP Office. However, I recommend that you contact me in any of the cases to be able to determine in advance the viability of your brand.
