FAQ
What types of office actions do you handle?
I handle almost all types from simple amendments (mark description, address, translation) to complex ones like Specimen refusal, Statement of Use, Merely Descriptive, and Likelihood of Confusion.
Do you guarantee approval of my trademark?
No. I cannot guarantee that the examiner will approve the application. I will submit strong arguments, but the final decision rests with the USPTO examiner.
What information do I need to provide
Please send your application serial number, USPTO Office Action letter, and any relevant details (specimens, images, etc.).
Can you help with Final Office Actions?
Yes, I can prepare responses to Final Office Actions as well.
Can you respond to USPTO office actions for Trademarks filed in other countries?
Yes, I do that on a daily basis.
Do you file the Response to USPTO?
Yes I do, and then I give you the Certificate of Filing which is a USPTO receipt for successfully filed Office action response.
What if the examiner issues another Office Action after filing my response?
Further Office Actions are often covered by your original application fee to the USPTO. If you need a response drafted for a subsequent action, that will require a new Gig order, as it is a new project with new arguments.
Does your fee include the USPTO filing fee?
No. My fee covers my professional drafting service only. The applicant (you) is responsible for paying all required USPTO fees, such as extension fees or petition fees, directly to the USPTO system.
How long will the response draft take?
This depends on the package selected and the complexity of the rejection. Basic and Standard packages typically take 2-3 days. Premium (Full Response) may require 4-5 days for proper research and drafting. I highly recommend ordering well before your USPTO deadline
What is included in the "Draft Response" vs. the "Full Response Package"?
The Draft Response is for simple, non-substantive issues (e.g., proper classification, formality errors). The Full Response Package is for complex, substantive rejections (e.g., Likelihood of Confusion, Prior Art) that require deep legal arguments.
