FAQ
What is a "dispositive motion"?
: It is a motion that, if granted by the judge, can "dispose of" or end your case (or a part of it) without a full trial. Examples include a Motion to Dismiss or a Motion for Summary Judgment. They are incredibly important.
Why do I need an attorney to draft this? Can't I just state the facts?
Unlike a complaint, motions and oppositions are pure legal argument. They require applying facts to legal standards and persuading a judge by citing binding case law and statutes. This is a skill, not just a recitation of facts.
What about deadlines?
Court deadlines are absolute. You MUST provide me with the date your document is due. I require a minimum number of days to complete the work, which we will agree upon before you order. Rush service may be available for a fee.
What is an appellate brief?
If you lose your case at the trial court level, an appellate brief is the written argument you submit to a higher court (the Court of Appeals) explaining why the trial judge made a legal error. It is a highly technical document.
Can you help me respond to discovery requests I received?
Yes. Responding to discovery requires careful drafting to avoid accidentally waiving privileges or giving the other side more than they are entitled to. Please contact me for a custom offer for discovery responses.
