How much is the USPTO government fee for the trademark application?
If you have a simple application, the cost is $440 for the government fee. If you have a very long list of products or niche products that aren't in the system, the cost is $690 per class.
How long do trademarks take?
About 10-16 months. It takes 8 months for an examining attorney at the USPTO to review your application. Once reviewed, the Trademark is published in the Trademark Official Gazette for a 30-day review period. If no oppositions were filed, allow the USPTO another 2 months to register your trademark.
If I add multiple classes will my cost to the USPTO increase?
Yes, the listed prices are PER CLASS. Adding more classes/categories of products to your application raises the fee (+$200 per additional class for lawyer fees and +$350 per class for government fees).
Would my brand name and logo be the same trademark?
No, a brand name and a logo are separate trademarks. You would need to file for two trademarks to have both protected. I always recommend filing both separately for full federal protection of your business
Do I have to be a US citizen to apply for a trademark?
No, but you must include your current citizenship in the application. If dual citizenship, you must choose only one for the application. If you are not a US citizen, you must have a US licensed attorney. Non-US citizens must choose the Premium gig.
Are there any additional fees I should know about?
If your trademark is not being used in commerce, the USPTO will charge you $150 filing fee, per class, to add evidence (formally called a Statement of Use) to prove you are using your trademark in commerce. You will have up to 36 months to provide this proof and pay this filing fee.
What does handling correspondence include?
I will handle the procedural office actions with the USPTO but substantive correspondence such as formal filings and refusals for likelihood of confusion, mere description, litigation etc. is not included in this gig.
